If you, the customer, are buying a customised and/or prescription product please make sure you have read and understand our prescription terms and conditions. We the supplier must receive payment of the whole of the price for the goods that you order before your order can be accepted. Once payment has been received by greenfieldeyecare.co.uk, hereon referred to as “We” / “Us” / “Our”, will confirm that your order has been accepted by sending an email to the email address provided in the order form. Our acceptance of the order brings into existence a legally binding contract between us and the customer Definitions

  1. the “contract” means the legally binding agreement between the supplier and the customer
    1. The “Supplier” shall be greenfieldeyecare.co.uk; The “Customer” shall refer to the purchaser of goods by way of the Supplier
  2. greenfieldeyecare.co.uk’s right to refuse your order.
    1. greenfieldeyecare.co.uk reserves the right to refuse acceptance of the order for any reason including, without limitation and whether or not payment has been received by greenfieldeyecare.co.uk, if:
      1. greenfieldeyecare.co.uk has insufficient stock to deliver the goods you have ordered;
      2. greenfieldeyecare.co.uk do not deliver to your area albeit all best endeavours will be considered in this regard; or
    2. If greenfieldeyecare.co.uk do refuse your order greenfieldeyecare.co.uk will notify you by e-mail and will re-credit to your account any sum deducted by greenfieldeyecare.co.uk from your credit /debit card as soon as possible but in any event within 7 days of your order subject to any bank time restraints and/or restrictions. greenfieldeyecare.co.uk will not be obliged to offer any additional compensation for the inability to complete an order due to the circumstances detailed above.
  3. Right to terminate the contract
    1. The Customer may terminate the contract with greenfieldeyecare.co.uk for the goods ordered at any time up to the end of the seventh working day from the day after the date the customer receives the ordered goods. The Customer does not need to give greenfieldeyecare.co.uk, any reason for terminating the contract nor will the customer have to pay any penalty other than postage of the products purchased for their return.
    2. To terminate the contract the Customer must notify greenfieldeyecare.co.uk in writing.
    3. If the Customer has received the goods before the termination of the contract then the Customer must return the goods back to greenfieldeyecare.co.uk contact address at the Customers own expense and risk. If the Customer terminates the contract but greenfieldeyecare.co.uk have already processed the goods for delivery the Customer must not unpack the goods or unreasonably affect the external packaging of the product to ascertain the content when they are received by the Customer and must return the goods back to greenfieldeyecare.co.uk at greenfieldeyecare.co.uk‘s contact address at the Customers own expense and risk as soon as possible.
    4. Once the Customer has notified greenfieldeyecare.co.uk that they are terminating the contract, any sum debited to greenfieldeyecare.co.uk from the debit/credit card will be re-credited to your account as soon as possible and in any event within 7 days of the order allowing for any bank time restraints or restrictions.
    5. If the contract is terminated but the return the goods to greenfieldeyecare.co.uk in the condition that they were despatched when delivered to the Customer or do not pay the costs of delivery, greenfieldeyecare.co.uk shall be entitled to deduct the direct costs of recovering the goods from the amount to be re-credited to you. Should the goods not be returned within 7 days of the credited amount being returned then greenfieldeyecare.co.uk reserve the right to seek recover of all reasonable expenses made in having to recover monies, including that available through the Courts
  4. Delivery of goods to you
    1. greenfieldeyecare.co.uk. will deliver the goods ordered by the Customer to the address provided to greenfieldeyecare.co.uk for delivery at the time the Customers makes the order. It is the responsibility of the Customer to ensure the correct details are provided
    2. Delivery will be made as soon as possible after the order is accepted and in any event within 28 days of your order.
    3. The Customer will become the owner of the goods ordered when they have been delivered Once goods have been delivered they will be held at the Customers own risk and greenfieldeyecare.co.uk will not be liable for their loss or destruction.
  5. Liability
    1. If the goods greenfieldeyecare.co.uk, deliver are not what the Customer ordered or are damaged or defective or the delivery is of an incorrect quantity, then (except where you are dealing as a consumer within the meaning of the Unfair Contract Terms Act 1977) greenfieldeyecare.co.uk, shall have no liability unless you notify greenfieldeyecare.co.uk in writing at greenfieldeyecare.co.uk contact address of the problem within 10 working days of the delivery of the goods in question.
    2. If you do not receive goods ordered within 28 days of the date on which they were ordered, then (except where you are dealing as a consumer) greenfieldeyecare.co.uk shall have no liability unless notified in writing at greenfieldeyecare.co.uk‘s contact address of the problem within 40 days of the date on which you ordered the goods. If the Customer notifies a problem to greenfieldeyecare.co.uk under this condition then at the Customers option greenfieldeyecare.co.uk will either:
      1. Make good any shortage or non-delivery;
      2. Replace or repair any goods that are damaged or defective upon return of the goods; or
      3. Refund to the Customer the amount paid for the goods in question by debit/credit refund or cheque And (except where you are dealing as a consumer) greenfieldeyecare.co.uk shall have no further liability to the Customer.
    3. Save as precluded by law and except where the Customer are dealing as a consumer, greenfieldeyecare.co.uk will not be liable for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem notified to greenfieldeyecare.co.uk under this condition and greenfieldeyecare.co.uk shall have no liability to pay any money by way of compensation other than to refund the amount paid for the goods in question under clause 6.2.3 above.
    4. The Customer must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from greenfieldeyecare.co.uk‘s site. The importation or exportation of certain of greenfieldeyecare.co.uk’s goods to the Customer may be prohibited by certain national laws. greenfieldeyecare.co.uk make no representation and accept no liability in respect of the export or import of the goods purchased.
    5. Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights the Customer might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit greenfieldeyecare.co.uk’s liability for any death or personal injury resulting from greenfieldeyecare.co.uk ‘s negligence.
  6. Notices Unless otherwise expressly stated in these terms and conditions, all notices from the Customer to greenfieldeyecare.co.uk must be in writing and sent to greenfieldeyecare.co.uk’s contact address at info@greenfieldeyecare.co.uk and all notices from greenfieldeyecare.co.uk to you will be displayed on greenfieldeyecare.co.uk ‘s website.
  7. Events beyond greenfieldeyecare.co.uk’s control greenfieldeyecare.co.uk shall have no liability to the Customer for any failure to deliver goods ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond greenfieldeyecare.co.uk reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident or considered an Act of God.
  8. Invalidity If any part of these terms and conditions is unenforceable (including any provision in which greenfieldeyecare.co.uk exclude greenfieldeyecare.co.uk’s liability) the enforceability of any other part of these conditions will not be affected to the extent that they are capable of continuing in force without the unenforceable term or condition.
  9. PrivacyThe Customer acknowledges and agrees to be bound by the terms of greenfieldeyecare.co.uk’s privacy policy.
  10. Third Party Rights Except for greenfieldeyecare.co.uk’s affiliates, directors, employees or representatives, a person who is not a party to this agreement has no right under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement but this does not affect any right or remedy of a third party that exists or is available apart from that Act.
  11. Governing Law The contract between greenfieldeyecare.co.uk shall be governed by and interpreted in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between greenfieldeyecare.co.uk.
  12. Customs When ordering goods from greenfieldeyecare.co.uk for delivery overseas the Customer may be subject to import duties and taxes, which are levied once the package reaches the specified destination. Any additional charges for customs clearance must be borne by the Customer; we have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country, so should contact local customs office for further information. Additionally, please note that when ordering from greenfieldeyecare.co.uk, the Customer is considered the importer of record and must comply with all laws and regulations of the country in which receiving the goods. The Customers privacy is important to greenfieldeyecare.co.uk and we will not share any information to be considered private with anyone outside of the remit of the Privacy Policy. greenfieldeyecare.co.uk would like our international customers and customers dispatching products internationally to be aware that cross-border deliveries are subject to opening and inspection by customs authorities.
  13. Entire Agreement These terms and conditions, together with greenfieldeyecare.co.uk’s current website prices, delivery details, contact details and privacy policy, set out the whole of greenfieldeyecare.co.uk’s agreement relating to the supply of the goods to you by greenfieldeyecare.co.uk and except where you are dealing as a consumer:
    1. Nothing said by any sales person on greenfieldeyecare.co.uk ‘s behalf should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any goods offered for sale by greenfieldeyecare.co.uk and in all instances the terms and conditions contained herein shall take precedent;
    2. Save for fraud or fraudulent misrepresentation, greenfieldeyecare.co.uk shall have no liability for any such representation being untrue or misleading.
  14. Prescription eyewear Prescription orders are customised for you. They may take a few weeks to build (typically 14 working days). You cannot return the product for an exchange or refund.
  15. greenfieldeyecare.co.uk is Committed to Providing the Highest Quality Products and Customer Service to Our Customers.
    1. If the Customer is Not Satisfied with the goods for any reason, greenfieldeyecare.co.uk do operate a 7-DAY MONEY BACK GUARANTEE even for unwanted goods, excluding prescription orders, subject to the following guidelines:

If the products are the subject of any warranty or guarantee given by the manufacturers or suppliers of those products, we guarantee that such products will be free from defects caused by faulty materials or poor workmanship for the period of that warranty or guarantee. Under this warranty or guarantee, we will, at our option, either repair or give a replacement of equivalent quality. Or we will issue a credit to the Customer.
    3. This is subject to: a. The Customer notifying us in writing within 3 days of first discovering the defect. This notification will be accepted by either post or email; b. The products having been used in an appropriate manner and/or as prescribed in the operating instructions (if any); c. The Customer delivering the products to us, at their own expense; and d. Us being satisfied that such defects exist and have not been caused by misuse, neglect, accident, improper storing, installation or handling or by repair or alteration not carried out by us. e. The Customer will not be entitled to receive any compensation, credit or refund in excess of that received by us under any guarantee or warranty given to us by the manufacturer or supplier of that product. Where the products are not the subject of any warranty or guarantee given by the manufacturers of those products and the Customer wishes to reject the products for whatever reason, then greenfieldeyecare.co.uk will accept the return of the products provided that the Customer returns the products to us within 7 days of them being delivered. This is subject to: a. In the case of unwanted products these must be returned to greenfieldeyecare.co.uk, in the same condition that they were despatched and must be unused. They must also include all original packaging and documentation. Any damage or loss to either the product, packaging or the documentation may affect the amount of refund made. b. Where the product ordered is defective then, subject to greenfieldeyecare.co.uk being satisfied that such defect exists and has not been caused by incorrect use, storage or handling, we will credit the Customer in full. When sending a return, the parcel is the Customers responsibility until it reaches us. This means the Customer is also responsible for the postage for the return parcel. We strongly recommend that the parcel is returned using an insured delivery service. Greenfieldeyecare.co.uk does not accept liability for parcels damaged during transit so we advise to wrap the product adequately to prevent this happening. Please be sure to include the following details with all returns: Your Daytime Telephone Number Your greenfieldeyecare.co.uk order no. The reason for the return For exchanges please enclose a cheque for £4.50 to cover the postage of the replacement item.
